Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

  • Right of Withdrawal: The period during which the consumer may withdraw from the agreement without giving any reason.

  • Consumer: A natural person who is not acting within the scope of a professional or commercial activity and who enters into a distance agreement with Nicola London.

  • Day: A calendar day.

  • Fixed-term Agreement: A distance agreement relating to a series of products and/or services, with deliveries or receipt taking place over a specified period.

  • Durable Medium: Any tool that enables the consumer or Nicola London to store information in a way that allows future consultation and unchanged reproduction.

  • Trader: Nicola London – the natural or legal person who offers products and/or services remotely to consumers.

  • Distance Agreement: An agreement concluded within the framework of a system organised by Nicola London for distance sales, whereby the agreement is concluded exclusively through one or more means of distance communication.

  • Distance Communication: Any means that can be used to conclude an agreement without the consumer and Nicola London being physically present at the same time.

  • Terms & Conditions: These general terms & conditions of Nicola London.

Article 3 – Applicability

These Terms & Conditions apply to every offer from Nicola London and to every distance agreement and order concluded between Nicola London and the consumer.

Before a distance agreement is concluded, these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed that the Terms & Conditions can be requested free of charge from Nicola London before the agreement is concluded.

If the agreement is concluded electronically, the Terms & Conditions may be provided digitally in a way that allows the consumer to easily store them on a durable medium. If this is not possible, it will be indicated where the Terms & Conditions can be consulted online and that they will be sent free of charge upon request.

In the event of specific conditions applying in addition to these Terms & Conditions, both will apply, and in case of conflict, the consumer may always invoke the most favourable provision.

If any provision of these Terms & Conditions is invalid or declared invalid, this will not affect the validity of the remaining provisions. The invalid provision shall then be replaced by a new one that comes as close as possible to the original intent.

Situations not covered by these Terms & Conditions will be interpreted in the spirit of these Terms.

Any ambiguities about the interpretation of one or more provisions shall also be resolved in the spirit of these Terms.


Article 4 – The Offer

If an offer has a limited validity period or is subject to specific conditions, this will be clearly stated in the offer.

All offers are non-binding. Nicola London reserves the right to modify or adjust an offer at any time.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make a proper assessment. If Nicola London uses images, they shall represent the product or service as faithfully as possible.

Please note: Product images on the website are for illustrative purposes and may slightly differ from the actual product (e.g., in colour or design) due to screen settings or manufacturing variations.

All images, specifications, and details in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.

Each offer contains clear information about what applies when the consumer accepts the offer, such as:

  • The price (excluding import duties and VAT on import – these costs are the customer’s responsibility).

  • Any shipping costs.

  • The manner in which the agreement will be concluded and which steps are required.

  • Whether the right of withdrawal applies.

  • Payment, delivery, and performance terms.

  • The validity period of the offer or the period during which Nicola London guarantees the price.

  • Any costs for distance communication (if different from the basic rate).

  • Whether the agreement will be archived, and if so, how the consumer can access it.

  • The possibility to review and, if necessary, correct data before finalising the purchase.

  • The languages, in addition to English, in which the agreement may be concluded.

  • Codes of conduct Nicola London adheres to and how these can be consulted.

  • Minimum contract duration in the case of long-term agreements.


Article 5 – The Agreement

Subject to the provisions of Article 4, the agreement is concluded when the consumer accepts the offer and meets the stated conditions.

If the consumer accepts the offer electronically, Nicola London will confirm receipt of the acceptance without delay by email. Until this confirmation has been received, the consumer may dissolve the agreement.

In the case of an electronic agreement, Nicola London shall take appropriate technical and organisational measures to secure data transfer and ensure a safe environment. If the consumer can pay electronically, Nicola London shall ensure secure payment methods.

Nicola London is entitled, within legal boundaries, to verify whether the consumer can meet their payment obligations and to check all other facts and factors relevant to a sound conclusion of the agreement. If Nicola London has valid grounds not to conclude the agreement, it is entitled to refuse an order or attach special conditions to execution.

Nicola London shall provide the consumer with the following information, in writing or on a durable medium, together with the product or service:

  • Contact details of customer service.

  • Terms and instructions for exercising the right of withdrawal, or clear information if it is excluded.

  • Information on guarantees and after-sales service.

  • The information referred to in Article 4.3, unless already provided.

  • The conditions for termination if the agreement has a duration of more than one year or is indefinite.

In the case of successive deliveries, the above only applies to the first delivery.

All agreements are subject to availability of the ordered products.


Article 6 – Right of Withdrawal

When purchasing products, the consumer has the right to withdraw from the contract within 30 days without giving any reason. The withdrawal period starts the day after the product has been received by the consumer or by a representative appointed by the consumer.

During the withdrawal period, the consumer shall handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to assess whether the consumer wishes to keep it. If the consumer exercises the right of withdrawal, the product must be returned to Nicola London in its original condition and packaging, with any included accessories and preferably in unused condition, in accordance with clear and reasonable instructions provided by Nicola London.

To exercise the right of withdrawal, the consumer must notify Nicola London within 30 days of receipt, preferably in writing or by email. After notification, the consumer must return the product within an additional 30 days. The consumer must be able to prove that the product has been returned on time, for example by providing proof of shipment to our warehouse in China.

Return requests will be processed within 14 business days after receipt of the return.

Please note: An order must be cancelled within 24 hours of being placed. After this time, the order can no longer be cancelled, and the consumer must wait for delivery. Once the package has been received, a return can be initiated in accordance with our return policy.

If the consumer does not notify Nicola London of withdrawal in time or does not return the product within the specified timeframe, the purchase becomes binding.


Article 7 – Return Costs

In the event of withdrawal, the consumer is responsible for all return shipping costs, including any customs duties.
